The Trade Submission Terms

These Submission Terms govern offers submitted to The Trade, a video series produced by Candie LLC, operating as Confection.

By submitting a proposed trade through The Trade submission form, you agree to these Submission Terms.

1. About The Trade

The Trade is a participatory entertainment series in which Confection attempts to exchange one item for another through a continuing chain of voluntary trades.

Submitting an offer allows Confection to consider your proposal. Submission does not guarantee that your offer will be featured, shortlisted, selected, or accepted.

Public voting and audience comments may help inform Confection’s decision. All audience voting is advisory. Confection retains final authority over eligibility, shortlisting, selection, verification, and whether any proposed trade proceeds.

2. Eligibility

To submit an offer, you must:

1.  Be at least 18 years old.

2.  Have the legal capacity to agree to these Submission Terms.

3.  Provide complete and reasonably accurate submission information.

4.  Own the item you are offering or have the owner’s authorization to submit the offer.

5.  Be legally permitted to possess and transfer the offered item.

6.  Submit from a location where the proposed trade can lawfully occur.

An authorized representative may submit an offer on behalf of an individual, business, organization, estate, or other owner. Before any trade becomes final, Confection may require the actual owner and every other person with a legal interest in the item to approve and sign the Selected-Trader Agreement.

Confection may request proof of age, identity, ownership, or authorization from a finalist or selected trader.

3. No Fee to Submit

There is no fee to submit an offer.

You are responsible for any costs you voluntarily incur while creating or sending your submission. Confection is not required to reimburse filming, photography, appraisal, authentication, document preparation, shipping estimates, or other submission-related expenses unless Confection agrees otherwise in writing.

4. Your Offer Is Initially Nonbinding

Submitting an offer communicates your genuine interest in making the proposed trade. It does not by itself transfer ownership or require you or Confection to complete the exchange.

A trade becomes binding only after the selected participant and Confection enter into a separate written Selected-Trader Agreement.

You may withdraw your offer before signing that agreement by contacting Confection at [CONTACT EMAIL]. Confection may stop considering an offer at any time before the Selected-Trader Agreement is signed.

5. Ownership and Authority

By submitting an offer, you represent that, to the best of your knowledge:

1.  You own the offered item or have permission from its owner to submit it.

2.  You have disclosed any shared ownership, lien, lease, financing agreement, security interest, restriction, or third-party claim affecting the item.

3.  The item has not been stolen or obtained unlawfully.

4.  You are legally able to transfer the item if selected.

5.  No undisclosed person must approve the transfer.

If the item is jointly owned, owned by a business, held by an estate or trust, or controlled by another person or entity, Confection may require additional authorization before proceeding.

6. Accuracy of the Offer

You agree to describe your offer honestly and to the best of your knowledge.

Your offer should disclose:

1.  The item’s current condition.

2.  Known damage, defects, missing components, or required repairs.

3.  Significant ownership or transfer restrictions.

4.  Any uncertainty concerning authenticity, history, provenance, celebrity ownership, prior use, age, value, or origin.

5.  Whether supporting certificates, receipts, titles, records, or other documentation are available.

6.  Any material difference between the item shown and the item that would actually be traded.

You may submit an item whose history or provenance cannot be proven with absolute certainty, provided that you describe the claim and its uncertainty accurately.

For example, an owner may describe an item as “said to have belonged to” a particular person when that description accurately reflects the available evidence. The owner may not knowingly present an uncertain claim as conclusively established.

Confection may preserve and repeat the owner’s claim using appropriate shorthand after clearly disclosing its source and level of verification.

7. Submission Materials

You must have the right to submit all photographs, video, audio, written material, records, and other content included with your offer.

Do not include:

1.  Copyrighted music, footage, photographs, artwork, or other material that you do not have permission to submit.

2.  Private information belonging to another person without permission.

3.  Confidential business information.

4.  Material that is unlawful, threatening, defamatory, fraudulent, or intentionally misleading.

The Trade Media and Appearance Release governs Confection’s review, recording, editing, publication, distribution, and promotional use of your submitted materials, interview, name, voice, image, likeness, and related story. These Submission Terms do not independently grant public media rights.

8. Verification and Interviews

Confection may request reasonable information to evaluate an offer, including:

1.  Additional photographs or video.

2.  A video interview.

3.  Dimensions, weight, condition, and location.

4.  Proof of ownership or authority.

5.  Existing receipts, titles, certificates, provenance records, or appraisals.

6.  Shipping, pickup, storage, customs, or delivery information.

7.  Confirmation that the offer remains available.

Confection generally uses proportionate verification. Preliminary contenders may receive simple confirmation requests. More extensive verification is normally reserved for the preferred trade, a necessary backup, or an unusually valuable or complicated offer.

Submitting an offer does not require Confection to authenticate the item or investigate every claim made by the submitter.

9. Selection Process

Confection may consider factors including:

1.  The likelihood that the offered item can generate a stronger future trade.

2.  Desirability, rarity, and collector or audience appeal.

3.  Verification strength.

4.  Condition and transferability.

5.  Story and promotional potential.

6.  Audience response.

7.  Shipping, travel, storage, customs, insurance, and other expenses.

8.  Legal, safety, scheduling, and production considerations.

Confection may select an offer that did not receive the largest audience vote or that has a lower estimated monetary value than another offer.

Confection may:

1.  Determine how many offers become finalists.

2.  Consider late submissions.

3.  Request additional information.

4.  Extend or reopen a submission period.

5.  Change a voting or selection deadline.

6.  Move to a backup offer.

7.  Decline every offer received.

8.  Pause, modify, or cancel a round when reasonably necessary.

10. Audience Voting

Any public poll, comment request, or audience vote is advisory.

The Audience Pick does not automatically become the selected trade. Confection may choose a different offer based on verification, trade potential, cost, logistics, legality, safety, responsiveness, or other relevant considerations.

Confection may disregard votes that appear automated, manipulated, duplicated, fraudulent, or otherwise unreliable.

11. Prohibited and Restricted Offers

You may not submit an item that is illegal to possess, transfer, export, import, ship, or receive.

Additional prohibited and restricted categories will are in The Trade Prohibited and Restricted Item Policy, which will be incorporated into these Submission Terms by reference.

Confection may reject any item that it determines presents unreasonable legal, safety, ethical, financial, transportation, storage, or production concerns.

An item’s appearance on the submission form, in a finalist video, or in audience voting does not constitute final approval.

12. Shipping, Delivery, and Exchange Costs

Each participant ordinarily arranges and pays to deliver the item they are offering to the recipient or exchange point identified in the Selected-Trader Agreement.

Confection ordinarily arranges delivery of the current chain item to the selected trader.

Before selection becomes final, the parties may agree in writing to another arrangement, including:

1.  Local pickup or an in-person exchange.

2.  A road-trip exchange.

3.  Direct shipment from a temporary custodian to a future trader.

4.  Collection by the receiving trader.

5.  Shared transportation costs.

6.  Professional shipping, storage, escrow, or third-party custody.

Confection may decline an offer when either side of the exchange would be excessively expensive, risky, delayed, or impractical.

Specific packing requirements, delivery deadlines, inspection rights, acceptance procedures, transfer of ownership, and risk of loss will be addressed in the Selected-Trader Agreement.

13. International Offers

International submissions are welcome and reviewed individually.

An international offer can proceed only when both sides of the exchange can be completed legally, safely, and economically. Confection may consider:

1.  Export and import restrictions.

2.  Customs documentation.

3.  Duties, taxes, brokerage charges, and processing fees.

4.  Shipping, collection, and delivery costs.

5.  Insurance and tracking.

6.  Transportation of the current chain item to the selected trader.

7.  Transportation of the offered item to Confection or another agreed recipient.

8.  Timing, storage, and border delays.

9.  Sanctions or other legal restrictions.

All customs declarations must accurately describe the item and use a reasonable declared value.

Confection may decline an international offer when the full two-sided exchange is restricted or impractical.

14. No Confidentiality

Do not submit information that you expect Confection to keep confidential.

Confection may receive similar or identical offers from other people. Submission does not prevent Confection from developing, producing, discussing, or accepting another offer, story, object, or concept that resembles yours.

Confection will handle personal information according to its Privacy Policy, but it does not accept a separate duty to protect business ideas, trade concepts, or other voluntarily submitted nonpersonal information as confidential.

15. Communications

By submitting an offer, you authorize Confection to contact you regarding:

1.  Clarification of your submission.

2.  Verification.

3.  Interviews.

4.  Shortlisting and audience voting.

5.  Selection.

6.  Shipping, delivery, or exchange logistics.

7.  Changes affecting the relevant trade round.

Consent to receive marketing emails, newsletters, or unrelated promotional messages will be requested separately and will remain optional.

16. Privacy

Confection’s collection, storage, use, and deletion of personal information are governed by the Confection Privacy Policy, available at [PRIVACY POLICY LINK].

Sensitive information, such as identification records, titles, ownership documents, and full addresses, may be requested only when reasonably necessary for verification or completion of a selected trade.

Do not upload highly sensitive documents through the general submission form unless Confection specifically instructs you to do so.

17. Changes to These Terms

Confection may revise these Submission Terms for future submissions.

The version displayed and accepted when you submit your offer will ordinarily govern that submission. If a material change needs to apply to an existing submission, Confection may request your additional consent.

18. Relationship to Other Agreements

These Submission Terms govern the initial offer, evaluation, and selection process.

They do not replace:

1.  The Trade Media and Appearance Release.

2.  The Selected-Trader Agreement.

3.  A custody or direct-transfer addendum.

4.  Any shipping, storage, escrow, title-transfer, or other agreement required for a particular item.

If an offer is selected, the terms of the later signed agreement will control the actual exchange.

19. Electronic Acceptance

By selecting the required acceptance checkbox and submitting the form, you confirm that you have read these Submission Terms, understand them, voluntarily agree to them, and intend your electronic acceptance to function as your agreement.

Confection may retain an electronic record of your submission, name, email address, date and time of acceptance, accepted document versions, and submission identification number.
