The Trade Media Release

This Media and Appearance Release (the “Release”) governs media submitted to or recorded in connection with The Trade, a video series produced by [CONFECTION LEGAL ENTITY NAME], operating as Confection ("Confection," "we," "us," or "our").

By accepting this Release, you give Confection permission to use the media, appearance, and identity rights described below. This Release does not govern selection of a trade or require either party to exchange an item.

1. Participant

“You” and “Participant” refer to the person accepting this Release and providing materials or participating in a recording.

You confirm that you are at least 18 years old and have the legal capacity to enter into this Release.

If you submit an offer on behalf of another person or organization, this Release applies only to your own appearance, statements, and materials unless that other person or an authorized representative separately provides the required permission.

2. Participant Materials

“Participant Materials” include any video, photographs, audio, written statements, graphics, stories, documents intended for public presentation, or other content that you voluntarily provide for possible use in The Trade or related Confection content.

Participant Materials may include:

1.  Your original submission video.

2.  Photographs or video of the offered item.

3.  Written descriptions and statements.

4.  Zoom, video-call, telephone, or in-person interviews.

5.  Exchange, packing, shipping, pickup, delivery, or road-trip footage.

6.  Follow-up videos, reactions, or updates.

7.  Other material you voluntarily provide for the program.

3. Permission to Use Your Identity and Appearance

You give Confection permission to record and use your name or approved display name, voice, photograph, image, likeness, appearance, statements, interview responses, general location such as your city, state, province, region, or country, and biographical information that you voluntarily provide.

Confection will not publicly display your full residential address, private telephone number, personal email address, identification documents, financial information, or other sensitive verification records unless you separately authorize that use or disclosure is legally required.

4. License to Participant Materials

You retain whatever copyright ownership you may have in Participant Materials that you created.

You grant Confection a worldwide, perpetual, nonexclusive, royalty-free, transferable, and sublicensable license to record, copy, reproduce, edit, excerpt, adapt, caption, translate, dub, reformat, combine, display, perform, stream, publish, distribute, transmit, and make Participant Materials available to the public in connection with The Trade, Confection programming, and the advertising, publicity, promotion, distribution, sponsorship, fundraising, and development of those activities.

Confection will not use your identity or likeness on unrelated standalone merchandise without your separate permission.

5. Footage Recorded by Confection

To the extent permitted by law, Confection will own the video, audio, photographs, interview recordings, and other production material that Confection or its production team records.

Your participation does not give you ownership of the finished episode, interview recording, edited footage, graphics, promotional content, or other Confection production materials.

6. Editing and Editorial Control

Confection may determine whether and how Participant Materials are used. Confection may shorten or rearrange an interview, select excerpts, combine your material with narration, music, graphics, captions, animation, or other footage, correct sound, color, framing, or image quality, create versions in different formats, translate or subtitle your statements, and use your material in promotional excerpts.

Confection cannot guarantee that every statement will appear or that material will be presented in the order recorded.

Confection will not knowingly edit your words to create a materially false statement that you did not make.

You waive the right to inspect or approve the final edit, captions, title, episode, promotional materials, or context of an authorized use before publication.

7. Artificial Intelligence and Synthetic Media

Confection may use automated or artificial-intelligence-assisted tools for ordinary post-production purposes, including transcription, captioning, translation, noise reduction, image stabilization, color or sound correction, background cleanup, reframing, formatting, search, organization, and editing assistance.

This Release does not authorize Confection to clone your voice, create a digital replica of you, generate a new performance that you did not give, create new statements and present them as statements you made, or use your likeness as a recurring synthetic character. Any such use would require separate written consent.

8. Authorized Uses

Authorized uses may include:

1.  Full episodes and Offers Episodes.

2.  Shorts, clips, teasers, trailers, recaps, montages, and follow-up content.

3.  Confection’s streaming service, websites, and applications.

4.  YouTube and other video platforms.

5.  Social-media platforms.

6.  Email newsletters.

7.  Press and publicity materials.

8.  Paid advertisements.

9.  Festival, screening, industry, investor, sponsor, fundraising, and distribution presentations.

10.  Archival use and later references to the trade chain.

Confection may authorize its employees, contractors, production partners, distributors, platforms, licensees, sponsors, publicity partners, successors, and assigns to use the materials for these authorized purposes.

9. No Guaranteed Use or Selection

Confection is not required to use or publish Participant Materials, feature you in an episode, interview you, identify you publicly, make your offer a finalist, select your proposed trade, complete a trade with you, or keep published material available for any particular period.

Confection may discontinue, postpone, edit, remove, or decline to use material at its discretion, subject to applicable law and any other written agreement.

10. No Compensation for Media Use

Unless Confection separately agrees otherwise in writing, you will not receive a fee, wage, royalty, residual, license fee, or other payment for authorized use of Participant Materials, your appearance, or your identity.

Any terms concerning an actual exchange of items will be addressed separately in the Selected-Trader Agreement. An item exchange is not compensation for the media permissions granted in this Release.

Confection may earn revenue from subscriptions, advertising, sponsorship, fundraising, licensing, distribution, or other exploitation of the program without owing additional compensation to you.

11. Your Rights and Permissions

You confirm, to the best of your knowledge, that:

1.  You created the Participant Materials or have permission to submit and license them.

2.  You have permission from any identifiable person who appears or speaks in them.

3.  You will not knowingly submit material containing copyrighted content that you lack permission to use.

4.  Your Participant Materials do not knowingly violate another person’s privacy, publicity, copyright, trademark, confidentiality, or other legal rights.

5.  Your statements are honest to the best of your knowledge.

You should avoid including minors or uninvolved third parties in your submission. Confection may request an additional release, remove or obscure a person, or decline to use material containing someone who has not provided appropriate permission.

12. Statements About the Offered Item

You authorize Confection to quote, summarize, paraphrase, or repeat statements you make about the offered item and to present supporting materials that you voluntarily provide for public use.

Confection may identify a statement as verified, supported by available documentation, reported or represented by the owner, or unverified or uncertain. Confection may use reasonable shorthand after the nature and uncertainty of the claim have been disclosed.

Confection may edit, qualify, correct, or decline to repeat a claim when necessary to avoid misleading the audience or a future trader. This section grants media permission only. The accuracy and verification duties associated with the offer are governed by the Submission Terms and, if selected, the Selected-Trader Agreement.

13. Withdrawal Before Public Use

You may ask Confection to stop using unpublished Participant Materials by contacting [CONTACT EMAIL]. Confection will make reasonable efforts to honor a timely request when the material has not been incorporated into a substantially completed, scheduled, or published production.

Once Participant Materials have been incorporated into a published episode, Short, advertisement, promotional asset, or substantially completed production, this Release cannot be revoked as to that existing content or its continued authorized distribution.

A media withdrawal request does not automatically withdraw your proposed trade. Withdrawal of a trade offer is governed by the Submission Terms and, when applicable, the Selected-Trader Agreement.

Confection may retain Participant Materials and related records for legal compliance, verification, dispute resolution, archival, and internal documentation purposes.

14. Release of Media-Related Claims

To the extent permitted by applicable law, you release Confection and its owners, officers, employees, contractors, production partners, distributors, platforms, licensees, successors, and assigns from claims arising directly from authorized use of Participant Materials, your identity, or your appearance under this Release, including claims concerning rights of publicity, privacy, editing, attribution, approval, or compensation.

This section does not authorize uses outside the scope of this Release and does not waive claims that cannot lawfully be waived.

15. Privacy

Personal information collected in connection with your submission or participation will be handled according to the Confection Privacy Policy, available at [PRIVACY POLICY LINK].

Confection may share Participant Materials and related information with employees, contractors, attorneys, accountants, production personnel, distributors, platforms, and other partners who reasonably need access to evaluate, produce, distribute, or promote The Trade.

Marketing and newsletter consent will be requested separately and is not required to submit an offer.

16. No Employment or Endorsement Relationship

Your participation does not create an employment, agency, partnership, joint-venture, performer, or confidential relationship with Confection.

Confection’s authorized use of your appearance or statements does not necessarily mean that you endorse Confection, and your participation does not mean that Confection endorses you, your business, or every claim associated with the offered item.

17. Relationship to Other Agreements

This Release governs media rights, recording, and your appearance in connection with The Trade.

It does not:

1.  Determine whether your offer is eligible or selected.

2.  Transfer ownership of the offered item.

3.  Require either party to complete a trade.

4.  Replace The Trade Submission Terms.

5.  Replace the Selected-Trader Agreement.

6.  Determine shipping, custody, taxes, risk of loss, inspection, or final acceptance of an item.

If another signed agreement contains more specific media terms for a selected trade, those specific terms will control to the extent of any direct conflict.

18. Electronic Acceptance

By selecting the required acceptance checkbox and submitting the form, you confirm that you have read this Release, understand it, voluntarily agree to it, and intend your electronic acceptance to function as your signature.

Confection may retain an electronic record of your submission, name, email address, date and time of acceptance, accepted document versions, and submission identification number.

19. Changes to This Release

Confection may revise this Release for future submissions or recordings.

The version accepted when you submit will ordinarily govern the Participant Materials submitted at that time. Confection may request additional consent if a materially different future use falls outside that permission.
